Legal Practice Management Course

Qualification to practise as sole proprietor or in partnership or as director of law corporation

If you are called on or after 1 March 1997, then you must be aware of the restriction imposed upon you to practice as a sole-proprietor or partner or director of a law corporation under section 75C of the Act and the need to complete the Law Society's Legal Practice Management Course.

"75C.---(1) No solicitor may practise as a solicitor on his own account or in partnership (whether in a law firm or a limited liability law partnership) or as a director of a law corporation unless he ---

 

 

(a) has successfully completed such legal practice management course within such time as the Council may by rules made under section 71 prescribe; and

(b) has, since being admitted as a solicitor, been employed for not less than 3 continuous years or 3 years out of a continuous period of 5 years in the practice of a solicitor in Singapore or in the practice of a law corporation or a limited liability law partnership; or

(c) has been employed as a legal officer for not less than 3 continuous years or 3 years out of a continuous period of 5 years."

 

The above section does not apply to a solicitor who has been in practice on his own or in partnership or as a director before 9 March 2007.

A solicitor may be exempted from the restriction described in section 75C of the Act if the Minister for Law is satisfied that a solicitor has gained substantial experience in law in Singapore or else where (section 75C(2) refers). The application, however, must be made to the Council which then seeks the Minister's approval on the solicitor's behalf. Section 75C will not apply if you practise as a partner with a lawyer of more than three years' practice (section 75C(3) of the Act).

Locum Solicitors
From 1 March 2005, solicitors can apply for a locum solicitor practising certificate. The relevant rule changes were gazetted on 15 February 2005, namely amendments to the following:
  • The Legal Profession (Professional Conduct) Rules
• The Legal Profession (Practising Certificate) Rules
• The Legal Profession (Professional Indemnity) Rules

To qualify to apply for a locum solicitor PC, in addition to the usual qualifications required to hold a normal PC, you are required to:
 
i) be a Singapore Citizen or Permanent Resident (Section 26, 1A of the Act).
ii) - In the last 3 or 3 out of 5 years preceding your locum solicitor PC application
- Have been in practice as:
    o a proprietor or partner of a law firm;
o a director of a law corporation;
o a full time employee in such a practice; or
o a legal officer

If you do not meet the practice experience requirements, you must fulfill certain mandatory training requirements before you apply for a locum PC.

Mandatory Training Requirements For Locum Solicitors

You are required to attend 10 hours of training approved by the Law Society, of which 6 hours should be in any of the following practice areas:

 
  Category 1 - Commercial/ corporate/ employment/ corporate finance/ commercial finance
  Category 2 - Conveyancing/ banking
  Category 3 - Crime
  Category 4 - Dispute resolution processes & procedure (including litigation, arbitration, mediation, adjudication)
  Category 5 - Information technology/ intellectual property
  Category 6 - Infrastructure/ projects/ construction
  Category 7 - Insurance/ probate & administration/ wills/ trusts/ tax/ wealth management
  Category 8 - Matrimonial/ family law
  Category 9 - Shipping/ admiralty/ international trade

Once you have met the mandatory training requirements, you must apply for a locum solicitor PC within 12 months.
