International Arbitration: Corporate Attitudes & Practice 2006
30 Nov 2006, 5.15-7.30pm, FTSE Room, Capital TowerThe
resolution of cross border disputes is becoming more sophisticated.
Increasingly, parties are choosing to resolve disputes away from the

PricewaterhouseCoopers embarked on a ground-breaking and
standard-setting study which introduced empirical methods in the study
of international arbitration to gauge the level of knowledge about
international arbitration among a wide sample of corporations around the
world and to test leading in-house counsel on certain myths and
perceptions about international arbitration.
The Law Society of Singapore and the Singapore Institute of
Arbitrators proudly present a talk that will cover the key findings of
this survey and discuss the opportunities for Singapore and the
Singapore legal fraternity in the light of these findings, in particular
the demand for the development of stronger regional arbitration centres,
including Singapore.

Gambling & the Law: Double or Nothing?
10 Nov 2006, 2.00-6.15pm, FTSE Room, Capital Tower, Level 9
With Singapore embracing Integrated Resorts as a key driver of its
tourism industry, gambling has been thrust into the local limelight in
the past 2 years with much discussion generated regarding economic gains
versus social mores. As Singapore moves from ubiquitous Toto and 4D
counters and Big Sweep tickets to increasingly diverse forms of gaming,
and as concerted moves are made to attract the international gaming
dollar as an economic proposition, the legal challenges continue to
evolve.
The Singapore Academy of Law and the Law Society of Singapore are proud
to present this seminar that discusses the legal aspects of a very
current topic including relevant legislation and case-law, and takes a
broader perspective of industry trends and developments, including the
impact and implications of new gambling platforms, channels and models
of collaboration. The seminar includes a panel discussion on the
challenges of cross-border enforcement and opportunities for the legal

The Buyer’s Guide to Arbitration: Dispute Resolution from a Party’s
Perspective
8 Nov 2006, 5.15-7.30pm, SGX Auditorium
At first thought it may seem that all participants (with the exception
of the tribunal) involved in the resolution of a dispute through
arbitration would have the same goal in mind – to win the day. And while
this may be true superficially, as we dig beneath the surface we find
that the different players – party, counsel, experts, fact witnesses,
etc. – each have different, and sometimes conflicting, views on the
situation, and oftentimes differing agendas. In this seminar jointly
presented by the Singapore Institute of Arbitrators and the Law Society,
we will examine the arbitration process through the eyes of a
protagonist, and provide insight into the thought processes of the
business person, which, at times, may be unfathomable to those in the
legal profession. The talk will also give business persons an overview
of the practicalities of managing an arbitration proceeding.

Immunity of Classification Societies
24 Aug 2006, 5.30-7.15pm, FTSE Room, Capital Tower, Level 9
Classification Societies have made tremendous contribution to safety of life at sea. However, what is not so apparent (perhaps being taken for granted) is that in almost every layer of the shipping industry as a commercial undertaking, the Classification Society plays a uniquely pivotal role. Without which, a shipowner would bring upon himself painful financial and commercial consequences. In port entry requirements, insurance coverage of ship and cargo, liability coverage, carriage of goods at sea, in ship charters, ship sales, shipbuilding contracts or towing contracts, it is a warranty or even a condition that the subject vessel must be a classed and class maintained vessel or it must conform to a certain classification standard.
What recourse is therefore open to parties who rely on the accuracy and sanctity of Classification Certificates? In this seminar by the Singapore Institute of Arbitrators, the speaker will use English precedents to examine the duty of care expected from the Classification Societies and the consequences that follow.

4 Jul 2006, 3-6pm, The Law Society of Singapore
Public policy is a highly debated topic globally and in Singapore today. It is particularly pronounced in arbitration as it is one of the most popular grounds commonly used by parties to set aside Arbitration Awards in Singapore courts. This introductory session will attempt to cover the basic principles and issues of public policy as well as case studies from overseas and locally.
The session is expected to benefit general law practitioners interested in the subject of international arbitration or newly admitted solicitors & advocates.

Corporate
Governance & REITS – Time for a Re-look?
30 May 2006, 8.45-10.30am, The Executives’ Club
Real Estate Investment Trusts ('REIT') have become an
important part of the investment landscape in Singapore.
To-date, there are 7 REITs listed on the Stock Exchange of
Singapore Limited. Another 3 are in various stages of
being listed. The Government is keen on promoting
Singapore as the venue of choice in Asia for the listing
of cross-border REITs. Though much has been said about
corporate governance and how it protects the position of
shareholders of listed companies, the position of
Unitholders in REITs has merited little discussion and
retail investors may be labouring under the impression
that they are accorded similar protection as shareholders
in listed companies. Join us for this timely re-look at
the corporate governance issues in listed REITs.

An Introduction to Syariah Law22 Mar 2006,
5.30-7.30pm, The Law Society of Singapore
Islamic law codifies beliefs that are deeply held by a
significant proportion of the world’s population and which
those believers consider to be immutable. Interestingly,
even in the West, it has been observed that Muslim lawyers
serve a new generation of immigrants more willing to bring
traditional disputes to secular courts. For those living
and working in Singapore, where 15% of the population
embraces Islam (according to the Census of Population
2000) and 60% of the population in neighbouring Malaysia
is Muslim, understanding the fundamental principles of
Syariah or Islamic jurisprudence becomes critical in the
context of work and personal relationships. Featuring 2
experienced Muslim law practitioners, this seminar is
targeted at non-Muslims who wish to gain a deeper
understanding of both the substantive and procedural
aspects of Syariah law.

Disputes: An Integrated Approach
13 Jan 2006, 3-6pm, The Law Society of Singapore
A staggering 55% of alliances and 78% of mergers and

Most alliances fail because alliance partners do not
understand their own or their partners’ true interests and
expectations. How do you and your client ensure that you
are in the ‘winning’ minority?
Whether you are a lawyer, corporate counsel, shareholder,
company director or partner in a firm, this Workshop helps

Society’s Future of the Legal Profession Conference
16 Feb 2006, 9am-5.30pm, Supreme Court Auditorium,

This century is an exciting and evolutionary time for the

expectations, business practices,
international/cross-border initiatives, technological
advances and new business structures. The Law Society’s
‘The Future of the Legal Profession’ Conference aims to
promote an in-depth discussion and sharing of ideas
amongst members from small to large law practices on the
various issues facing our profession and law practices. Be
part of this rare opportunity to take stock of where our
profession and law practices are heading, and key issues
and challenges in the next decade. More details on our

Development of Contract Law in Singapore
29 September 2005, 3-6pm, The Law Society of Singapore

recent developments in Singapore contract law. This

Digilandmall.com Pte Ltd; Tribune Investment
Trust Inc. v Soosan Trading Co. Ltd); |
| • |
undue influence (Bank of East Asia Ltd v
Mody Sonal M & Ors); and |
| • |
unconscionability, good faith and problems in

Case Law Updates – A Discussion on Infiniteland
v Artisan and TCF v Bilgin
20 September 2005, 5.30-7.30pm, The Law Society of
Singapore
Led by Mr. Paul Downes (who acted in the 2 cases
discussed), this seminar examines recent UK case law
developments involving (a) Share Sale Agreements and (b)
Freezing Injunctions and would of interest and relevance
to practicing lawyers, corporate counsel and company
directors and management alike.
The first discussion of Infiniteland v Artisan
[2005] EWCA 758 focuses on how this case radically changes
the test for adequate disclosure in a standard share sale
agreement and raises difficult issues for those advising
on the scope and terms of disclosure letters. The speaker
will review the law, give guidance on how to approach
disclosure and appropriate drafting of clauses to prevent
prejudicing purchasers. The second discussion is of TCF
v Bilgin [2004] EWHC 2732 where the
well-established Chabra jurisdiction was challenged, the
speaker will analyse the Chabra jurisdiction, the emerging
C Inc jurisdiction and how they can operate to exclude
corporate veil difficulties in freezing the underlying
assets of a corporation, owned by a defendant, but against
which no substantive cause of action exists.

Announcing a Brand New Personal Development Workshop Series on
‘Money Matters’
Lawyers invest in developing expertise in their areas of practice, but
when it comes to financial planning - be it for themselves or their
firms - most do not have the expertise, much less the time. What can
lawyers do to make sure that their hard work does not go to waste? How
can they ensure they save enough for a comfortable retirement? Are they
taking too little or too much risk? How should they manage their firm’s
cash flow to ensure it stays afloat and thrives?
This new Series launched in February 2005 aims to address all these
questions and more, without the technical jargon. Best of all, each
Workshop is structured to be practical and easily digestible so you can
immediately apply the lessons leant to make a difference in your
personal financial management. Topics covered include:
