8th Legal Practice Management Course
7, 14 & 21 Feb 2007

The 8th Legal Practice Management Course pursuant to section 75C of the Legal Profession Act will be conducted over 3 full days on 7, 14 and 21 February 2007. Since 2006, the Course has been restructured into a comprehensive 3-day programme based on participant feedback as well as the evolving demands of practice, yet retaining the tried and tested core topics of previous intakes.

If you are admitted as a solicitor on or after 1 March 1997 and you wish to practise on your own account or in partnership or as director of a law corporation, you are required, as one of the pre-conditions, to complete this Course.

This Course is a vital toolkit containing all the fundamentals you need to start and manage your law practice. Topics covered include:

Priming Your Practice for Success
Managing Operational Risk through PRIMELAW
Day 2: Financial Management of Your Law Practice
Understanding Solicitors’ Accounts Rules
Day 3: A Lawyer’s Ethical Obligations

The Legal Profession Act & Relevant Rules - Your Obligations & Privileges

Registration fees are $840 for members and $1,260 for non-members (inclusive of 5% GST). Where attendance is mandatory, please register your interest by completing the Notice of Registration. International Arbitration: Corporate Attitudes & Practice 2006

The resolution of cross border disputes is becoming more sophisticated. Increasingly, parties are choosing to resolve disputes away from the courts through the use of international arbitration. PricewaterhouseCoopers embarked on a ground-breaking and standard-setting study which introduced empirical methods in the study of international arbitration to gauge the level of knowledge about international arbitration among a wide sample of corporations around the world and to test leading in-house counsel on certain myths and perceptions about international arbitration.

A 2006 Review of Updates & Developments in Singapore Trust Law & Practice

The Buyer’s Guide to Arbitration: Dispute Resolution from a Party’s Perspective

In this seminar jointly presented by the Singapore Institute of Arbitrators and the Law Society, we will examine the arbitration process through the eyes of a protagonist, and provide insight into the thought processes of the business person, which, at times, may be unfathomable to those in the legal profession. Competition Law Issues Affecting Intellectual Property Transactions

Immunity of Classification Societies

Classification Societies have made tremendous contribution to safety of life at sea. However, what is not so apparent (perhaps being taken for granted) is that in almost every layer of the shipping industry as a commercial undertaking, the Classification Society plays a uniquely pivotal role. Without which, a shipowner would bring upon himself painful financial and commercial consequences. In port entry requirements, insurance coverage of ship and cargo, liability coverage, carriage of goods at sea, in ship charters, ship sales, shipbuilding contracts or towing contracts, it is a warranty or even a condition that the subject vessel must be a classed and class maintained vessel or it must conform to a certain classification standard.

What recourse is therefore open to parties who rely on the accuracy and sanctity of Classification Certificates? In this seminar by the Singapore Institute of Arbitrators, the speaker will use English precedents to examine the duty of care expected from the Classification Societies and the consequences that follow.

Nuts & Bolts Series: A 5-Year Review of Contract Law Developments

Contract law is the operating system that underpins commercial law, and is fundamental for a proper understanding of commercial transactions. It is an area of law which never stays still, and constantly evolves by statutory intervention and judge-made law. This seminar provides a broad overview of developments in contract law in Singapore since 2001, and also refers to major developments in commonwealth jurisdictions. Public Policy in International Commercial Arbitration

Public policy is a highly debated topic globally and in Singapore today. It is particularly pronounced in arbitration as it is one of the most popular grounds commonly used by parties to set aside Arbitration Awards in Singapore courts. But it remains a complex, academic and highly controversial subject. So far, there have been no successful attempts in Singapore to set aside Awards on this ground, yet.

This introductory session will attempt to cover the basic principles and issues of public policy as well as case studies from overseas and locally.

vMPCD Turns One!

1st April 2006 marks the first anniversary of the Law Society’s vMCPD Scheme – a 2-year pilot project to deliver more varied and value-added Training & Continuing Professional Development (CPD) programmes to members and to gather data for the future implementation of a mandatory CPD scheme for the profession. During vMCPD, members are encouraged to attend CPD Programmes voluntarily and no mandatory standards or reporting requirements are imposed. Find out more about vMCPD.

1. You chalk up CPD Hours when you attend events organised by any of the 20 external training providers (including SAL, IP Academy, SIAC, SMC, LexisNexis, Key Media) who have applied for recognition under the Society’s vMCPD Scheme?

An Introduction to Syariah Law

Islamic law codifies beliefs that are deeply held by a significant proportion of the world’s population and which those believers consider to be immutable. Interestingly, even in the West, it has been observed that Muslim lawyers serve a new generation of immigrants more willing to bring traditional disputes to secular courts. For those living and working in Singapore, where 15% of the population embraces Islam (according to the Census of Population 2000) and 60% of the population in neighbouring Malaysia is Muslim, understanding the fundamental principles of Syariah or Islamic jurisprudence becomes critical in the context of work and personal relationships. Featuring 2 experienced Muslim law practitioners, this seminar is targeted at non-Muslims who wish to gain a deeper understanding of both the substantive and procedural aspects of Syariah law.

The 7th Legal Practice Management Course has been restructured and includes new topics of current relevance to practitioners such as anti-money laundering regulations, expanded sections on Owning and Managing a Law Practice, Professional Ethics and Financial Management and a session on PrimeLaw. If you are admitted to practice after 1 March 1997, you are required to complete this course pursuant to section 75C of the Legal Profession Act in order to practise on your own. Where attendance is mandatory, please register your interest by completing the Notice of Registration.

A Roundtable Discussion on Recent Trends & Developments in Corporate Insolvency Law

The Insolvency Practitioners Association of Singapore Limited (IPAS) is organising a Roundtable Discussion on ‘Recent Trends & Developments in Corporate Insolvency Law’ on 9 January 2006 from 3.30 to 6.30pm. This roundtable discussion focuses on the leading pronouncements on corporate insolvency law delivered by the Singapore Courts in the last few years.

Emphasis will be placed on case law in certain areas where there is noteworthy local jurisprudence, including schemes of arrangement, avoidance of transactions and insolvency office-holders’ duties and rights. The extent to which local courts have recently departed from, developed or modified the law from other Commonwealth jurisdictions to suit the Singapore context will also be examined. Case Law Updates – A Discussion on Infiniteland v Artisan and TCF v Bilgin

Led by Mr. Paul Downes (who acted in the 2 cases discussed), this seminar examines recent UK case law developments involving (a) Share Sale Agreements and (b) Freezing Injunctions and would of interest and relevance to practicing lawyers, corporate counsel and company directors and management alike.

The first discussion of Infiniteland v Artisan [2005] EWCA 758 focuses on how this case radically changes the test for adequate disclosure in a standard share sale agreement and raises difficult issues for those advising on the scope and terms of disclosure letters. The speaker will review the law, give guidance on how to approach disclosure and appropriate drafting of clauses to prevent prejudicing purchasers. The second discussion is of TCF v Bilgin [2004] EWHC 2732 where the well-established Chabra jurisdiction was challenged, the speaker will analyse the Chabra jurisdiction, the emerging C Inc jurisdiction and how they can operate to exclude corporate veil difficulties in freezing the underlying assets of a corporation, owned by a defendant, but against which no substantive cause of action exists.

‘Children & the Law’ – A Regional Joint Conference by LAWASIA and The Law Society of Singapore


27-28 May 2005, Swissotel Merchant Court, Singapore


An international panel of speakers comprising experienced family law practitioners, academics specialising in child law, professionals who work with children and policy-makers will discuss a wide range of contemporary issues involving children and the law in the Asia Pacific region.

At the plenary session, current issues on custody & access, the role of experts, child abduction & cross-border enforcement juvenile justice and children with special needs will be addressed. Featured talks include posthumous sperm donation, separate representation for children and the impact of the recent tsunami disaster on affected children. The conference will also promote sharing of information amongst practitioners of different jurisdictions on child law issues.

A Commitment to Continued Excellence

As a testament to the legal profession’s commitment to ensure quality representation for the community, the Law Society will launch its Voluntary Minimum Continuing Professional Development Scheme (‘vMCPD’) in April 2005.

vMCPD is designed to help lawyers chart their own continuing professional development in terms of their expertise, practice and professionalism. To help achieve this, the Society will recommend certain CPD best practices and launch a suite of complimentary services for members. This includes an easy-to-use online portal that will allow you and your practice to manage your training history.
